01Parties and scope
The supplier will be the entity identified in the legal notice. The offer targets businesses and independent professionals for their business activities. Customer status must be verified: the “professional” label alone does not remove potentially applicable statutory protections, including those for some small businesses. Any consumer offer requires appropriate terms covering the corresponding rights and guarantees.
02Service and options
The planned offer includes a marketing website, a WindCloud address, hosting, HTTPS, maintenance and content management. Included page, storage, traffic, support and editing limits must be defined in the order description. Custom domains, bespoke services and business modules such as orders or reservations must be priced separately when not expressly included.
03Ordering and publication
The planned journey presents the preview, scope, total price, billing frequency and terms before explicit acceptance and payment. Customers confirm their authority and content rights. Orders are confirmed on a durable medium and the accepted terms version is retained. Publication timing and technical prerequisites must be specified before payment. Viewing a preview does not cause a charge or activation.
04Pricing, invoicing and payment
Planned price: USD 19.99 per month, excluding any applicable taxes. The total and currency must be shown before confirmation; any bank conversion fees remain the customer’s responsibility. Monthly advance payment through Stripe is planned. Discounts, billing dates, accepted payment methods and refund rules will be specified at launch. No early-payment discount is planned.
05Term, renewal and cancellation
The template provides for a monthly subscription renewing automatically until cancelled. Cancellation from the customer workspace would take effect at the end of the paid period with no further renewal. Used periods would not be refunded unless required by law, due to supplier non-performance or agreed otherwise. Price increases would be notified at least 30 days in advance with an opportunity to cancel before the new billing period. These arrangements must be confirmed and implemented in the service.
06Late payment
For business relationships governed by French law, the template uses the European Central Bank refinancing rate plus 10 percentage points for late-payment interest, subject to the statutory minimum, and the EUR 40 fixed recovery charge where applicable. Non-payment may lead to suspension following notice and a remedy period to be defined. Justified urgent security measures may take effect sooner.
07Domains and ownership
Customers retain their rights in their own content. A licence limited to providing the service permits its hosting and display. WindCloud components and templates remain subject to their rights and licences; source-code ownership is not transferred without explicit agreement. Domain purchase, renewal, registrant, fees and transfer conditions must be disclosed separately; the intended registrant is the customer.
08Support, data and service termination
Support hours and channels, response times, backups, recovery times and any uptime commitments must be completed. Export scope and format, the retrieval period after cancellation, any fees and the deletion schedule must be disclosed before subscription. Accounting records subject to legal retention are distinguished from website content.
09Liability and disputes
Customers are responsible for the lawfulness of their content and business, and the supplier for meeting its obligations. Any exclusions or liability caps must be proportionate and validated; this template sets no general cap. Complaints will be directed to the publisher contact to seek an amicable resolution. Applicable law and jurisdiction must be completed after confirming the country, the parties’ status and mandatory rules.
